The Great Chain of Being has been recognized for fifty years as the masterpiece of the History of Ideas movement in America. Lovejoy's work stimulated deeper research into our heritage, which has demonstrated that the idea of the chain of being has not lost its vitality. However, Lovejoy would probably be surprised that hierarchy is now defended in philosophy of science, in ontology and metaphysics, in ethics and aesthetics, and in philosophical anthropology. This volume presents concepts of hierarchy and the (...) great chain of being from Plato, Aristotle, Plotinus, medieval and Renaissance thinkers, Hindu philosophy, and authors of the twentieth century. This volume represents the ideas of twenty scholars, among whom are Dominic O'Meara, Ronald Hathaway, Ewert Cousins, John Sommerfeldt, Lewis Ford, David Blumenthal, and Marion and Paul Kuntz. The editors have compiled a bibliography of four hundred and fifty items and an index of names, places, and concepts which allow the reader immediate access to the variety as well as the unity of ideas. Jean Bodin, renowned for his powerful intellect and breadth of knowledge, was truly a renaissance man. His works on political and legal thought set him apart as one of the most brilliant minds of the period. The harvesting of data about people, organizations, and things and their transformation into a form of capital is often described as a process of “accumulation by dispossession,” a pervasive loss of rights buttressed by predatory practices and legal violence. Yet this argument does not square well with the fact that enrollment into digital systems is often experienced as a much more benign process: signing up for a “free” service, responding to a “friend’s” invitation, or being encouraged to “share” content. In (...) this paper, we focus on the centrality of gifting and reciprocity to the business model and cultural imagination of digital capitalism. Relying on historical narratives and in-depth interviews with the designers and critics of digital systems, we explain the cultural genesis of these “give-to-get” relationships and analyze the socio-technical channels that structure them in practice. We suggest that the economic relation that develops as a result of a digital gift offering not only masks the structural asymmetry between giver and gifted but also permits the creation of the new commodity of personal data, obfuscates its true value, and naturalizes its private appropriation. We call this unique regime “accumulation by gift.”. (shrink)

Several quantitative surveys have been conducted internationally to gather empirical information about physicians’ general attitudes towards health care rationing. Are physicians ready to accept and implement rationing, or are they rather reluctant? Do they prefer implicit bedside rationing that allows the physician–patient relationship broad leeway in individual decisions? Or do physicians prefer strategies that apply explicit criteria and rules?

Imperfect efficiency in healthcare delivery is sometimes given as a justification for refusing to ration or even discuss how to pursue fair rationing. This paper aims to clarify the relationship between inefficiency and rationing, and the conditions under which bedside rationing can be justified despite coexisting inefficiency. This paper first clarifies several assumptions that underlie the classification of a clinical practice as being inefficient. We then suggest that rationing is difficult to justify in circumstances where the rationing agent is or (...) should be aware of and contributes to clinical inefficiency. We further explain the different ethical implications of this suggestion for rationing decisions made by clinicians. We argue that rationing is more legitimate when sufficient efforts are undertaken to decrease inefficiency in parallel with efforts to pursue unavoidable but fair rationing. While the qualifier ‘sufficient’ is crucial here, we explain why ‘sufficient efforts’ should be translated into ‘benchmarks of efficiency’ that address specific healthcare activities where clinical inefficiency can be decreased. Referring to recent consensus papers, we consider some examples of specific clinical situations where improving clinical inefficiency has been recommended and consider how benchmarks for efficiency might apply. These benchmarks should state explicitly how much inefficiency shall be reduced in a reasonable time range and why these efforts are ‘sufficient’. Possible strategies for adherence to benchmarks are offered to address the possibility of non-compliance. (shrink)

Three‐dimensional structured illumination microscopy (3D‐SIM) has opened up new possibilities to study nuclear architecture at the ultrastructural level down to the ∼100 nm range. We present first results and assess the potential using 3D‐SIM in combination with 3D fluorescence in situ hybridization (3D‐FISH) for the topographical analysis of defined nuclear targets. Our study also deals with the concern that artifacts produced by FISH may counteract the gain in resolution. We address the topography of DAPI‐stained DNA in nuclei before and after (...) 3D‐FISH, nuclear pores and the lamina, chromosome territories, chromatin domains, and individual gene loci. We also look at the replication patterns of chromocenters and the topographical relationship ofXist‐RNA within the inactive X‐territory. These examples demonstrate that an appropriately adapted 3D‐FISH/3D‐SIM approach preserves key characteristics of the nuclear ultrastructure and that the gain in information obtained by 3D‐SIM yields new insights into the functional nuclear organization. This volume contains thirteen papers that were presented at the 2017 Annual Meeting of the Canadian Society for History and Philosophy of Mathematics/Société canadienne d’histoire et de philosophie des mathématiques, which was held at Ryerson University in Toronto. It showcases rigorously reviewed modern scholarship on an interesting variety of topics in the history and philosophy of mathematics from Ancient Greece to the twentieth century. A series of chapters all set in the eighteenth century consider topics such as John Marsh’s techniques (...) for the computation of decimal fractions, Euler’s efforts to compute the surface area of scalene cones, a little-known work by John Playfair on the practical aspects of mathematics, and Monge’s use of descriptive geometry. After a brief stop in the nineteenth century to consider the culture of research mathematics in 1860s Prussia, the book moves into the twentieth century with an examination of the historical context within which the Axiom of Choice was developed and a paper discussing Anatoly Vlasov’s adaptation of the Boltzmann equation to ionized gases. The remaining chapters deal with the philosophy of twentieth-century mathematics through topics such as an historically informed discussion of finitism and its limits; a reexamination of Mary Leng’s defenses of mathematical fictionalism through an alternative, anti-realist approach to mathematics; and a look at the reasons that mathematicians select specific problems to pursue. Written by leading scholars in the field, these papers are accessible to not only mathematicians and students of the history and philosophy of mathematics, but also anyone with a general interest in mathematics. Educational transitions play a pivotal role in shaping educational careers, and ultimately social inequality. Whereas parental socioeconomic status (SES) and cognitive ability have long been identified as key determinants of successful educational transitions, much less is known about the role of socio-emotional skills. To address this gap, the present study investigated whether Big Five personality traits predict success in the transition from secondary school to vocational education and training (VET) above and beyond SES, cognitive ability, and other covariates. Using data (...) from Starting Cohort 4 of the German National Educational Panel Study (NEPS; N = 4,137), we defined seven indicators of successful transition: obtaining a VET position, number of acceptances for VET positions, starting a VET position, (the absence of) dropout intentions and actual dropout, final VET grade, and satisfaction with VET. The results revealed that some Big Five traits were incrementally associated with several indicators of transition success. Conscientiousness emerged as the single most relevant trait, predicting all the transition success indicators but one (dropout intentions). The other Big Five traits had much weaker and less consistent links with transition success. Extraversion predicted the final VET grade and obtaining a VET position; Agreeableness was linked to a higher risk of dropout. Openness and Emotional Stability had no incremental effects on transition success. There was also some evidence for both compensatory and synergistic interactive effects, with Openness moderating mainly the effects of parental SES (on dropout intentions, actual dropout, and number of acceptances), and Agreeableness moderating the effects of cognitive ability (on obtaining a VET position, number of acceptances, and satisfaction with VET). Although individual effect sizes were small, the Big Five’s joint contribution to transition success was non-negligible, and often larger than that of sociodemographic characteristics and cognitive ability. Our results suggest a hitherto underappreciated contribution of personality to successful transitions to VET. (shrink)

When subordinates have suffered an unfairness, managers sometimes try to compensate them by allocating something extra that belongs to the organization. These reactions, which we label as managerial Robin Hood behaviors, are undertaken without the consent of senior leadership. In four studies, we present and test a theory of managerial Robin Hoodism. In study 1, we found that managers themselves reported engaging in Robin Hoodism for various reasons, including a moral concern with restoring justice. Study 2 results suggested that managerial (...) Robin Hoodism is more likely to occur when the justice violations involve distributive and interpersonal justice rather than procedural justice violations. In studies 3 and 4, when moral identity was low, both distributive and interpersonal justice violations showed similar relationships to managerial Robin Hoodism. However, when moral identity was high, interpersonal justice violations showed a strong relationship to managerial Robin Hoodism regardless of the level of distributive justice. (shrink)

Background Genuine uncertainty on superiority of one intervention over the other is called equipoise. Physician-investigators in randomized controlled trials need equipoise at least in studies with more than minimal risks. Ideally, this equipoise is also present in patient-participants. In pediatrics, data on equipoise are lacking. We hypothesize that 1) lack of equipoise at enrolment among parents may reduce recruitment; 2) lack of equipoise during participation may reduce retention in patients assigned to a less favoured treatment-strategy. Methods We compared preferences of (...) parents/patients at enrolment, documented by a questionnaire, with preferences developed during follow-up by an interview-study to investigate equipoise of child-participants and parents in the BeSt-for-Kids-study. This trial in new-onset Juvenile Idiopathic Arthritis-patients consists of three strategies. One strategy comprises initial treatment with a biological disease-modifying-antirheumatic-drug, currently not standard-of-care. Semi-structured interviews were conducted with 23 parents and 7 patients, median 11 months after enrolment. Results Initially most parents and children were not in equipoise. Parents/patients who refused participation, regularly declined due to specific preferences. Many participating families preferred the biological-first-strategy. They participated to have a chance for this initial treatment, and would even consider stopping trial-participation when not randomized for it. Their conviction of superiority of the biological-first strategy was based on knowledge from internet and close relations. According to four parents, the physician-investigator preferred the biological-first-strategy, but the majority stated that she had no preferred strategy. In phase 2, preferences tended to change to the treatment actually received. Conclusions Lack of equipoise during enrolment did not reduce study recruitment, mainly due to the fact that preferred treatment was only available within the study. Still, when developing a trial it is important to evaluate whether the physicians’ research question is in line with preferences of the patient-group. By exploring so-called ‘informed patient-group’-equipoise, successful recruitment may be enhanced and bias avoided. In our study, lack of equipoise during trial-participation did not reduce retention in those assigned to a less favoured option. We observed a change for preference towards treatment actually received, possibly explained by comparable outcomes in all three arms. (shrink)

The essay theorizes the responsibilities moral agents may be said to have in relation to global structural social processes that have unjust consequences. How ought moral agents, whether individual or institutional, conceptualize their responsibilities in relation to global injustice? I propose a model of responsibility from social connection as an interpretation of obligations of justice arising from structural social processes. I use the example of justice in transnational processes of production, distribution and marketing of clothing to illustrate operations of structural (...) social processes that extend widely across regions of the world. The social connection model of responsibility says that all agents who contribute by their actions to the structural processes that produce injustice have responsibilities to work to remedy these injustices. I distinguish this model from a more standard model of responsibility, which I call a liability model. I specify five features of the social connection model of responsibility that distinguish it from the liability model: it does not isolate perpetrators; it judges background conditions of action; it is more forward looking than backward looking; its responsibility is essentially shared; and it can be discharged only through collective action. "Schwarzen Hefte" haben umfassender und deutlicher als je zuvor die Verbindungen zwischen Philosophie und Politik bei Heidegger sichtbar werden lassen und damit eine neue Debatte uber den Rang dieses Denkens entfacht. DEnn die dort enthaltenen Texte demonstrieren, dass Philosophie, Metapolitik und Politik bei Heidegger eine Einheit bilden, zu der die Befurwortung des Nationalsozialismus und der Antisemitismus gehoren. INs Zentrum der kritischen Revision ruckt das erste Hauptwerk von 1927, "Sein und Zeit", das nahezu unangefochten als epochaler Beitrag zur Philosophie (...) des 20. JAhrhunderts gilt. DIe "Schwarzen Hefte" fordern eine "Destruktion" dieses Werks auch insofern heraus, als die dort prasentierten Selbstinterpretationen das philosophische Profil dieses Denkens scharfen und neue Gesichtspunkte fur die Diskussion seiner Substanz im philosophischen und ideologischen Kontext des 20. JAhrhunderts eroffnen. 90 Jahre nach seinem Erscheinen stellt sich der philosophischen Forschung die kritische Auseinandersetzung mit "Sein und Zeit" als unabweisbare Aufgabe. IM Vordergrund stehen hierbei zwei Fragen: Wie ist das Unternehmen einer in der "Fundamentalontologie" des Daseins begrundeten temporalen Ontologie der systematischen Intention und Durchfuhrung fachphilosophisch zu beurteilen? This article explores the position of women in the sport of surfing. I contend that within surfing there remain many forms of oppression that have not been given appropriate attention in feminist studies. In this article I apply Iris Marion Young's analysis from “Throwing Like a Girl” to the sport of surfing. Young's article offers many insights into forms of domination and oppression that pervade the sport, and that are demonstrated through the restricted movement of female surfers. I conclude (...) by making suggestions for how to address these issues in surfing through a greater promotion of big-wave surfing. (shrink)

Inspiracje, kierunek oraz kontekst przedstawionej interpretacji wyznaczają istotne przeobrażenia współczesnej humanistyki, której krajobraz został ukształtowany przez liczne kontrtekstualne zwroty. Artykuł przedstawia główne motywy Marionowskiej fenomenologii donacji, takie jak kontrmetoda, dar, sakrament, objawienie, oddany, wydarzenie, przygodność, fenomen nasycony, świadek itp., doszukując się w nich performatywnych instrukcji. Artykuł kończy się wielowątkową krytyką Mariona fenomenologii donacji, pokazując dlaczego nie zdaje ona egzaminu i musi ustąpić fenomenologicznej zasadzie performancji.

El concepto de los fenómenos saturados y su posterior desarrollo y evolución en la obra de Marion han suscitado la discusión por el problema de la hermenéutica. En esta discusión surge la necesidad de un discernimiento hermenéutico de los fenómenos y la posibilidad de clarificar criterios para este, abriendo el debate a una ética de la fenomenalidad. Para esto proponemos revisar la obra de Marion para encontrar los elementos que nos puedan ayudar en este camino.

Le présent ouvrage collectif contient les Actes d'un colloque international bilingue sur l'action, les attitudes et la décision que nous avons organisé en hommage à notre regretté collègue J.-Nicolas Kaufmann à Trois-Rivières du 3 au 5 octobre 2002. L'ouvrage présente et discute d'hypothèses, d'enjeux et de théories contemporaines sur l'action, les attitudes, la rationalité et la décision. La première partie intitulée Pensées, actions et engagements contient des contributions de John Searle, Daniel Vanderveken, Candida Jaci de Sousa Melo et Raimo Tuomela (...) traitant de problèmes généraux de la philosophie de l'esprit et de l'action. Dans la deuxième partie de l'ouvrage intitulée Phénoménologie, ontologie et philosophie de l'esprit, nous avons regroupé, autour d'un texte de Nicolas Kaufmann, quatre études qui traitent diversement de la contribution de la phénoménologie classique, principalement de la phénoménologie de Husserl, à des questions centrales de la philosophie contemporaine dans les domaines de la philosophie de l'esprit, de la théorie de l'action et de l'ontologie formelle. La troisième partie de l'ouvrage, Causalité et naturalisme, réunit trois contributions qui portent sur des questions centrales de la philosophie contemporaine. Daniel Laurier se penche sur la question de savoir si le normativisme sémantique est compatible avec le naturalisme sémantique, alors qu'André Leclerc et Wilson Mendonça s'intéressent à la notion de causalité mentale et examinent différents arguments qui contestent le bien-fondé de cette notion. La dernière partie de l'ouvrage intitulée Rationalité et décision réunit trois contributions logico philosophiques de Storrs McCall, Mathieu Marion et Michel Paquette qui traitent de la rationalité des agents lors de leurs prises de décision et délibérations. Originally, the idea of interviewing Iris Marion Young in Barcelona came about after she accepted an invitation to give a public lecture at the Law School of Pompeu Fabra University in May 2002. I had first met Iris back in 1999, at a conference in Bristol, England, and I was impressed deeply by her personality and ideas. We kept in touch since then and exchanged papers and ideas. She was very keen to come to Spain (it seems that her (...) mother had lived some years in Mallorca) and she finally travelled to Barcelona with her husband and daughter in spring 2002. The lecture, which she entitled "Women, War, and Peace," was meant to be the closing session of a course on Gender and the Law, and was also part of a series of seminars annually organized by the legal philosophy department (the Albert Calsamiglia Seminar). Her work was quite well-known among several Catalan philosophers and political scientists and professor Angel Castiñeira-who, at the time, was the director of Idees (Ideas), a Catalan journal published by the Centre d'Estudis de Temes Contemporanis (Center for the Study of Contemporary Issues)-suggested that she could give a second lecture, which they would publish together with an interview I could prepare. She accepted both proposals, and I started to think of a questionnaire for the interview while I was at Queen's University in Canada earlier that year. Idil Boran, a philosopher and good friend who did her doctorate at Queen's, offered to help me with this endeavour, since she also admired Iris as both a scholar and a person. Together we prepared the questions and sent them to her once she was back in Chicago, as there was not time to conduct the interview in person while she was in Barcelona. In fall 2002, she sent some answers to our questions, but the document was unfortunately incomplete. She was busy at the time, so we didn't want to pressure her to finish the interview. Eventually, the editors of Idees decided to publish the manifest about the war in Iraq subscribed by a large number of American Intellectuals together with fragments of Iris's (antiwar) lectures and an article that she wrote together with Daniel Archibugi, "Envisioning a Global Rule of Law." The interview was thus left unpublished. Both Idil and I thought it would be worthwhile to publish it somewhere else, but, for one reason or another, Iris didn't have the time to complete it and we kept postponing the project. At some point, she said that the questions she left unanswered were too complex or challenging to give a short or quick answer, and that she would need to reflect on them to provide detailed responses. Later, we learned she was ill and we didn't feel it was right to insist on those questions being answered. The issue came up again when she accepted to participate as a keynote speaker at the World Congress of Legal Philosophy held in Granada in June 2005. She then said she would come first to Barcelona (where she and Nancy Fraser had been invited to a workshop by the Catalan Women Institute) and suggested we could sit in a cafe and talk about the issues left out in those unanswered questions. Unfortunately, she had to cancel this trip because of her medical treatment, and I did not have the privilege of sharing time with her again. Une recherche sur l’insertion adulte après un placement a été menée auprès de cent vingt-trois personnes dans le cadre d’un village d’enfants SOS. Sont présentés ici les résultats concernant les relations fraternelles pendant le placement et aujourd’hui. Si les liens avec la fratrie biologique restent privilégiés, la cohabitation a modifié les représentations du lien fraternel et a permis d’acquérir de nouvelles ressources relationnelles. L’écart d’âge entre fratries, les troubles du comportement et les fortes disparités éducatives initiales jouent un rôle déterminant (...) sur les relations. Ces résultats soulignent l’importance d’une évaluation préliminaire fine et pluridisciplinaire, explorant les caractéristiques individuelles de chaque enfant mais également la dynamique relationnelle de la fratrie.
